Terms and Conditions

  1. 1. Our Agreement

    These terms and conditions ('Terms') apply to your use of our mobile application ('Klink App'), our website, and our services described below and form part of the agreement between you and Klink App Limited ('Klink', 'we', 'us'). Our company number is 15470987 and our registered office is at LABS Atrium, Chalk Farm Road, London, United Kingdom NW1 8AH.
    By using the Klink App and website you agree to these Terms. You should read these Terms carefully along with our Privacy and Cookie Policy and only use our service if you are over 18 and you agree to them.
    These Terms have no fixed or minimum duration. They will apply until either you or we end this agreement (see 'Your right to cancel' and 'Our right to suspend restrict or end this agreement').

  2. 2. What is Klink App?

    Klink is a digital app for all things related to your money and your home buying plans that does key things for you:
    Klink App organises your finances so you can see all your different online accounts, for example bank accounts, savings accounts and credit cards in our Klink App meaning you can see your money in one place. We do this by using regulated Open Banking technology to communicate with your third-party bank account providers in a secure way.
    Klink App allows you to generate a personalised home buying plan and timeline. By providing standard information Klink App allows you to have an estimate of the time it will take for you to buy a home as well as how to improve it.
    Klink App allows you to manage and improve your spending by creating dedicated spending missions and tracking against it.
    Klink App provides educational quizzes with the aim of increasing your financial and general literacy.
    Klink App provides a “Home Readiness Score” which will provide indication on how ready you are to buy your target property based on financial conduct and budget information.
    Klink App organises daily and weekly prize competition and prize draw with cash prizes. For more information please refer to Prize Competition Terms and Conditions and Prize Draw Terms and Conditions.
    Although Klink App works to identify opportunities for you to save money and better control your finances it does not provide advice on your financial circumstances and should not be interpreted as ‘advice’.

  3. 3. How does Klink do it?

    By securely processing your personal data Klink can provide its essential functions. Without access to and the right to process your personal data as needed Klink cannot perform its main tasks for you. We prioritise your privacy and security ensuring your data is always protected with bank-level security.
    Please refer to our Privacy and Cookie Policy for details on how we collect information about you and how we protect you and your data.
    Klink operates independently from the providers of your personal accounts that we connect to. We are not endorsed by these providers though we may receive payments from them if we promote their products and services on Klink App through website links.
    As part of our service Klink may offer content, website links and offers from various third parties including your account providers. If you switch to a new product or service through Klink these third parties may pay us. We strive for accuracy but we are not responsible for the products and services provided by these third parties – these are governed by the third parties' terms and conditions.
    When Klink makes tailored product suggestions for you we do not base these suggestions on the payment we receive – we maintain our integrity in this regard.

  4. 4. What does Klink cost?

    Klink is free to use with no subscription charge or price that you are required to pay. Klink reserves the right to introduce paying versions of the Klink App in the future.

  5. 5. Using Klink

    To use Klink you need to download the Klink App and register to create a Klink account using your legal name and email address. You can only register once.
    If you choose not to use Klink for a period of time we may pause some features which depend on our processing of your information. These features will recommence when you login to the Klink App again.
    Your use of the Klink App is also subject to the terms and conditions and privacy policies of the app store you downloaded it from.
    Some parts of the Klink service depend on other people (third parties and partners). We always try to keep Klink available though we can't promise it always will be or that it will work perfectly particularly if the Klink App or a partner service is undergoing maintenance. If this happens we’ll tell you about it if we think you need to know and will get things back up and running as soon as we can.
    For the Klink App to work your device needs to meet our operating system requirements. You can check these here. If we know your device’s operating system and we plan to stop supporting it we’ll give you at least 30 days’ notice. If you don’t install operating system updates and new versions of the Klink App the Klink App might not work properly or at all and your subscription fee will continue to be charged so we recommend installing updates when they become available.
    The Klink App also may not work as designed if your device has been changed or tampered with (better known as ‘jail breaking’ or ‘rooting’) or if you use software which may interfere with our ability to deliver the services.

  6. 6. Intellectual Property

    Klink grants you a non-exclusive and non-transferable licence to use the Klink App and website for your personal use only. Klink has the right to revoke your licence at any point if you do not comply with these Terms. All other rights in the Klink App and website are reserved by Klink or its licensors. Klink (or its licensors) own all intellectual property rights in the Klink App and in the material published on them. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.
    Our status (and that of any identified contributors) as the authors of the content on the Klink App and website must always be acknowledged. You must not use any part of the content on our Klink App or website for commercial purposes without obtaining a licence to do so from us or our licensors.

  7. 7. Prohibited Uses

    You agree:
    Not to reproduce, duplicate, copy or re-sell any part of our site or Klink App in contravention of the provisions of these terms.
    Not to access without authority, interfere with, damage or disrupt:

    • • any part of our website or Klink App;
    • • any equipment or network on which our website or Klink App is stored;
    • • any software used in the provision of our website or Klink App; or
    • • any equipment or network or software owned or used by any third party.

  8. 8. Keeping you secure

    When registering, you will set a security PIN, which must be kept secret. If you forget it, we can assist with a reset under certain conditions. We will never ask for your PIN, so do not share it with anyone, even if they claim to be from Klink.
    The Klink App can also utilise your device's biometric features, such as fingerprint or facial recognition, if you choose to enable them.
    It is essential to secure your login details with any service that holds your financial information. We ensure your Klink security credentials are protected from third-party access and transmitted securely.
    Take all necessary measures to keep your security PIN and the device with the Klink App safe. Do not share your PIN or allow others to use it. Avoid leaving your device unattended while logged into the Klink App. If you dispose of your device, ensure you delete the Klink App.
    If your device with the Klink App is lost or stolen, or if you suspect someone knows your PIN, notify us immediately. We will help you change your PIN (see 'Contact with Klink'). Klink is not liable for any losses resulting from your PIN being disclosed or accessed by others.

  9. 9. Connecting your personal accounts

    To use all the features of Klink, you'll need to link your online personal accounts, such as current accounts and credit cards.
    We use secure Open Banking technology from a third-party provider to access details about your account balances and transactions. You must give explicit consent to your account provider before we can access this information.
    Our service can also retrieve information like transaction history from your accounts for use with other third parties. If you choose this option and give your explicit consent, we will share this information with you and the specified third party as per your instructions.
    We will regularly request the necessary information from your account providers, based on your consent, until it expires or is withdrawn. Klink will only request the information needed to provide our services and will not ask for data that could be used fraudulently. For example, we may request an account number but not any secret passwords or security codes.
    If you no longer want your account information displayed in the Klink App or stored by Klink, you can remove these accounts via the Klink App or by emailing us at [email protected].
    You can withdraw your consent for us to access your account information at any time by contacting your account provider.
    Klink does not verify the accuracy of information from your account providers. You should check your accounts to avoid overdrafts and ensure you have sufficient funds. We are not responsible for keeping you constantly aware of your account balances or ensuring the balances we show are always current.

  10. 10. Klink Prizes

    Sometimes we'll offer rewards for specific actions like connecting your accounts, following Klink on social media, taking daily quizzes, providing information about yourself or inviting friends to join Klink.

  11. 11. Contact with Klink

    We will provide you with information and Klink notifications primarily through the Klink App, although we may also send you information to your email address or mobile number by SMS where we consider this appropriate. Look at our Privacy Notice for more information on how this works. You are responsible for maintaining and regularly checking the Klink App or your email inbox for information and notifications from us.
    If your contact details (including your mobile phone number or email address) change, you should tell us as soon as you can or update these in the Klink App if that feature is available. We will communicate with you in English.

  12. 12. Your right to cancel

    You have a right to cancel the free version of Klink at any time, without charge. You can request this by emailing us at [email protected] or from within the Klink App if that feature is available.

  13. 13. Our right to suspend, restrict or end this agreement

    We may stop providing the service if you’ve not used Klink for a while, but we’ll always check with you first before we do.
    We may also close or freeze your account without your permission if you have been abusive to a member of Klink staff or community member or submitted inappropriate and/or offensive content.
    We may at any time suspend, restrict, or end your use of our service, your account or the Klink App if we think your security may have been breached, or your privacy could be at risk through attempted fraudulent activity, or if your location presents a risk to the security of Klink, including if:
    1. we reasonably believe that your security PIN has not been kept safe or the security of your Klink App or the device on which it has been installed has been or could be compromised;
    2. we reasonably suspect that your security PIN, the Klink App, or the devices on which they have been installed or accessed from, has been used fraudulently or without your permission;
    3. we reasonably suspect you are fraudulently attempting to gain access to Klink offers or rewards;
    4. your account is being accessed from specific locations which Klink deems a high security risk; or
    5. we need to do so to comply with the law of any jurisdiction.
    Unless informing you would compromise reasonable security measures or otherwise be unlawful, we will inform you before suspending, restricting or cancelling our service, your account or the Klink App, and we will tell you our reasons why we’ve done this. If it is not practical to inform you in advance and unless doing so would compromise reasonable security measures or otherwise be unlawful, we will inform you immediately afterwards, giving the reasons why we’ve suspended or cancelled your service. We will allow you to resume your use of the Klink App or the service as soon as practical after the reasons for stopping its use cease to exist.
    If we need to contact you in respect of suspected fraud or any other security threat we will do so in the way that we think is the most secure in the circumstances.

  14. 14. Our liability

    If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach, or our failure to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time you accepted these Terms, both we and you knew it might happen.
    We only provide Klink App for domestic and private use. You agree not to use the product for any commercial, business or resale purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
    We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation.
    If defective digital content which we have supplied damages a device or digital content belonging to you, and this is caused by our failure to use reasonable care and skill we will either repair the damage or pay you compensation. However, we will not be liable for damage which you could have avoided by following our advice to apply an update offered to you free of charge.
    We are not liable for business losses. We only provide the Klink App for your domestic and private use. If you use the Klink App for any commercial, business or re-sale purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

  15. 15. Connecting your personal accounts

  20. 20. Making changes to this agreement

    These Terms will always be available in the Klink App and on our website.
    We can make changes to these Terms from time to time. As this agreement has no fixed duration, we can't predict all the reasons why we might change these Terms, but we have set out some of these below. We'll only ever make changes that are proportionate and reasonable and if we have a valid reason for doing so, taking into account your interests (even if it is not one of the reasons set out below).
    We might make changes because:
    1. we have made changes to our technology or other systems
    2. we have extended the services we can offer
    3. there have been changes to legislation, changes in regulatory requirements or new case law that affects us
    4. there have been changes in the cost to us of funding our service, or
    5. for any other valid reason.
    We will implement minor changes immediately (unless we are required to give you notice by law) and will give you reasonable advance written notice by email or through the Klink App of any intended significant change to the Terms along with the new version of the Terms. If you don't agree to the changes, you can close your Klink account by emailing us at [email protected] or from within the Klink App. If you don’t close your Klink account, we’ll assume that you’re happy with the changes we’ve made. You have a right to end this agreement at any time before the proposed change takes effect.

  21. 21. How to make a complaint

    At Klink, we are committed to providing a service of the very highest standard. We recognise that sometimes things can go wrong, and when they do, we want you to tell us so we can make them right as soon as possible. So if you’re unhappy with something, then please make sure you let us know by emailing us at [email protected].
    When you contact us, we’ll aim to resolve the issue straight away.
    If we’re not sure whether you’d like to raise a formal complaint, we’ll check back with you to make sure we understand fully so we can address your request in the most appropriate way.
    Where we believe we can resolve your complaint within three working days, we will send you our response within that timeframe.
    If the issue is more complex or we can’t resolve the problem within three working days:
    • We’ll send you an email to confirm we’ve received your complaint within that timeframe.
    • We’ll always aim to provide a final response to your complaint within 15 calendar days. In exceptional circumstances, if there is a delay beyond 15 days, we’ll keep you posted on our progress explaining the reasons for the delay and the date on which we’ll provide a final response (which will be no later than 35 working days from the date we received your complaint).
    • When we provide our final response, we’ll confirm our decision on your complaint, what we’ll do to put things right and information about the Financial Ombudsman Service.
    If you’re not satisfied with our final response, where you are eligible, you’ll have the right to refer your case to the Financial Ombudsman Service (FOS).

  22. 22. Other important terms

    Klink may transfer its rights and obligations under these Terms to another organisation. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights under the contract.
    You need our written consent to transfer your rights under these Terms to someone else.
    These Terms are between you and us. No other person shall have any right to enforce any of the terms.
    Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
    Even if we delay in enforcing this contract, we can still enforce it later. If we do not insist immediately that you do anything you are required to do under these Terms, or if we delay in taking steps against you in respect of your breach, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date.
    These Terms, and all our dealings with you are governed by the laws of England and Wales. Any dispute can be dealt with by an English and Welsh court unless your address is in Scotland (where you can choose between the courts of England and Wales or the courts of Scotland); or Northern Ireland (where you can choose between the courts of England and Wales or the courts of Northern Ireland).
